ROYALTIES FOR RADIO BROADCAST OF SOUND RECORDINGS TO BE FIXED | 26 September, 2020

The Intellectual Property Appellate Board (IPAB) has issued a public notice dated 18th September, inviting suggestions from people before it fixes the royalties payable for broadcast of sound recordings through radio. Under section 31D of the Copyright Act, 1957, read with Rule 31 of the Copyright Rules, 2013, the IPAB is required to fix royalties for communication of sound recordings to the public by way of broadcast through radio. The Music Broadcast Ltd. and other broadcasters have filed an application in this regard.

Rule 31(3) of the Copyright Rules, 2013 says that any owner of copyright or any broadcasting organisation or any radio broadcaster or any other interested person may, within thirty days from the date of publication of a public notice of the kind published by the IPAB, give its/his/their suggestions in writing, with adequate evidence as to the rate of royalties to be fixed for the broadcast of sound recordings and musical work through radio.
