A special NDPS court recently granted Fallon Ajaz Guliwala, wife of actor Ajaz Khan, bail in a drugs case. She was arrested in the case in November 2024, over a month after a staff member was allegedly arrested for ordering 100 grams of mephedrone (MDMA) through a courier service. The reason for the bail was that despite there being CCTV cameras in the house of the accused, she was directed to shut them down.
The court raised concerns over the intention of the officer conducting the raid in telling Fallon to shut down the CCTV cameras and the lack of videography during the raid. “…one thing cannot be ignored, that there is CCTV footage in the house of the accused, but as per the contention of the applicant, she was directed to shut down the CCTV,” special judge C.S. Datir said, adding, “If it happened, the intention of the officer to shut down the CCTV creates doubt regarding the raid. It goes to the root of the matter.”
In a seven-page order, the judge said that the material evidence was seized by the officer concerned. “The applicant is a lady having children. For the last four months, she is in jail. Though the investigation is going on, further investigation cannot fill up the lacuna of videography,” the judge explained. He asked Guliwala to furnish a surety of Rs. 1 lakh.
Seeking bail, Fallon’s lawyer submitted to the court that she had no knowledge of the alleged contraband found on the premises as it was a shared residence with multiple family members, and she did not have exclusive possession. Opposing the bail plea, the special public prosecutor and investigating officer submitted that the postal department seized an imported parcel on September 30, 2024. This parcel contained 100 grams of MDMA, and the parcel was in the name of staff member Suraj Gaud who had been arrested.
