HC EXPUNGES REMARKS AGAINST JUHI CHAWLA IN 5G CASE, REDUCES FINE TO RS. 2 LAKH | 28 January, 2022

The Delhi high court on January 27 expunged remarks against Juhi Chawla in connection with a plea challenging the rollout of 5G wireless networks in the country. A bench of Justices Vipin Sanghi and Jasmeet Singh also reduced the costs imposed by a single judge on the actress from Rs. 20 lakh to Rs. 2 lakh. The two-judge bench agreed with Juhi’s stand that she did not take up the 5G case in a frivolous and casual manner.

The bench, however, indicated to Juhi that a litigant must use his or her own intelligence while filing documents in court.

It may be recalled that the high court had on June 2 termed the petition filed by Juhi Chawla against the rollout of 5G technology in India as “defective” and done for “media publicity”. Describing Juhi’s move as “very shocking”, Justice J.R. Midha had wondered why the actress had not made a representation to the government before rushing to the court. A day before the hearing in court in June, Juhi Chawla had tweeted to her followers to join the online court proceedings and had shared the link for the online hearing. A man had joined the virtual hearing and had started to sing a song from Juhi’s Hum Hain Rahi Pyar Ke. After he was removed, he had logged in again under a different name and had sung another song. He was removed once again. Undeterred, he had joined under yet another name and had started to sing a song from Juhi starrer Aaina. He was removed over again. The judge had then asked the court master to contact the Delhi police and request them to identify the person so that contempt proceedings could be started against him for his conduct.
