LOAN DEFAULT CASE: HC RECALLS ORDER TO ATTACH ACTOR SIVAJI GANESAN’S HOUSE | 22 April, 2025

The Madras high court on April 21 recalled its order to attach the house of late actor Sivaji Ganesan in a case related to non-repayment of loan by his son, Ramkumar, and grandson, Dushyanth. Justice Abdul Quddhose recalled the order while allowing a plea moved by actor Prabhu, claiming that his brother, Ramkumar, did not have any stake in their father’s T Nagar house.

The high court had passed the attachment order on March 3 on a plea moved by the lender to execute a decree in its favour. A loan of Rs. 3.75 crore was given by Dhanabakkiam Enterprises to Eshan Productions, represented by Dushyanth and his wife, Abirami, for producing Jagajala Killadi. Arbitration proceedings were initiated against him as he failed to repay the loan.

As per the order, a decree was issued in favour of Dhanabakkiam Enterprises to exploit all the rights in connection with the film, including its OTT rights. Dushyanth was also ordered to pay Rs. 9.39 crore to the firm, including 30% interest. But since the film was never completed, the arbitral decree could not be executed by Dhanabakkiam Enterprises. The company then moved an execution petition to attach Sivaji Ganesan’s house on the assumption that Dushyanth’s father, Ramkumar, held a share in it. It wanted the court to execute the arbitral award dated May 4, 2024, passed in favour of Dhanabakkiam Enterprises.

However, during the hearing, the court was informed that Prabhu was the sole owner of the house.
