Producer Vashu Bhagnani’s real estate company, Pooja Devcon, has been penalised by the Maharashtra Real Estate Regulatory Authority (MahaRERA) for not registering a real estate project with the regulator. The project under question is a residential one on Linking Road at Khar in Bombay.
The fact about the non-registration came to light when complainant Nitin Matlani was insisting on possession of his apartment. According to Nitin, the reality dawned upon him only after he started getting into the details. In his complaint, Matlani submitted that the construction of the building was delayed and that he had not yet received possession of his flat. He sought relief for the same.
As per section 3 of the Real Estate (Regulation and Development) Act, a promoter in Maharashtra cannot advertise, market, sell or offer or invite anyone to purchase any plot, apartment and building without registering the project as per the provisions of RERA.
