WHAT’S SHOWN IN TRAILER NEED NOT BE PART OF FILM: SC | 23 April, 2024

The Supreme Court on April 22 ruled that what is shown in a film’s trailer need not be there in the film too. The judgement came in the case of the Jabra fan song from Yash Raj Films’ Fan. The apex court’s order came as a relief to Yash Raj Films, producers of Fan, starring Shah Rukh Khan. The Supreme Court reversed the order of the National Consumer Disputes Redressal Commission (NCDRC) which had asked YRF to not only pay the cost of the litigation to the complainant but also a fine of Rs. 10,000 as the song was missing in the film. Earlier, the zilla forum had not granted any relief to the complainant. But the appeal by the complainant before the NCDRC had been allowed. The NCDRC levied the fine on YRF. Aggrieved, YRF filed an appeal in the apex court.

According to the complainant, Afreen Fatima Zaidi, she had seen the Jabra fan song in the trailer of Fan and had booked tickets for herself and her family to watch the film. However, she stated in her complaint, that the song was not there in the film and hence she had felt cheated. The NCDRC had granted the complainant relief and asked YRF to pay her Rs. 10,000 by way of fine. The Supreme Court reversed the judgement of the NCDRC as, according to it, the trailer is made only to attract the audience to the cinemas to watch the film but it doesn’t promise that every scene, dialogue or song in the trailer would be in the film too.
