VICTORY FOR JACKIE SHROFF IN SC IN ARBITRATION MATTER | 11 November, 2021

Jackie Shroff on November 10 proved victorious in the Supreme Court in the arbitration matter between him and Ratnam Sudesh Iyer. The latter had preferred an appeal against the order of the division bench of the Bombay high court which said that Jackie Shroff was entitled to US $1.5 million for withdrawing all complaints against Iyer and for not publicising the same, and a further amount of US $2 million as proceeds from sale of his shares in Multi Screen Media Pvt. Ltd.

Iyer took the plea that Jackie’s wife had written two mails to him (Iyer) and had also marked some associates, in June 2011, which amounted to publicising the matter. He claimed that Jackie was, therefore, liable to refund him the US $3.5 million. However, the apex court said that Jackie Shroff could not be penalised for mails written by his wife who was not even a party to the arbitration proceedings. The arbitrator had held that Jackie was not entitled to receive US $1.5 million and the further amount of $2 million for the lapses by his wife, and for other technical reasons. A single judge of the Bombay high court in May 2020, however, reversed the arbitration award. A division bench of the same court in April this year upheld the single judge’s order. The Supreme Court upheld the order of the division bench.
