A sessions court in Bombay on 6th December granted producer-financier Bharat Shah and his son, Rajiv, pre-arrest bail in a case of alleged assault on policemen. Additional sessions judge D.S. Deshmukh granted the two anticipatory bail and asked them to appear before the police every Monday until the chargesheet was filed. The bail amount was fixed at Rs. 25,000.
Bharat Shah and Rajiv had claimed in their anticipatory bail application that they were falsely implicated in the case as the police officer in question was agitated and aggressive.
The Gamdevi (Bombay) police had in the early hours of 23rd November arrested Bharat Shah’s grandson and two others following a brawl at a pub in South Bombay. Bharatbhai and Rajiv reached the police station and allegedly tried to pressurise the officials into releasing Bharatbhai’s grandson, Yash. The two even allegedly instigated Yash to fight with a police officer, following which other policemen intervened. A case of assault was registered against the two Shahs and Yash under relevant sections of the India Penal Code and the Maharashtra Police Act.
The anticipatory bail application of Bharat and Rajiv Shah alleged that the policemen were beating up Yash and the other accused, and were treating them in an inhuman and illegal manner.
