SC ASKS HC TO EXPEDITE MAMTA KULKARNI’S PLEA IN DRUGS CASE | 29 August, 2020

The Supreme Court on 27th August dismissed a special leave petition filed by Mamta Kulkarni and requested the Bombay high court to expedite the hearing of her 2018 petition to quash the drug charges against her. Mamta had approached the apex court on 28th February, 2020, with a petition against a high court order of 26th August, 2019, whereby the court had adjourned her petition for quashing criminal proceedings against her for “paucity of time”. Her plea was that the pendency was impinging on her fundamental rights to effective disposal of the case and to leading a life with dignity in view of “vexatious criminal proceedings against her”.

While the Supreme Court dismissed her petition, it requested the Bombay high court to take up and dispose of her petition of 2018 as expeditiously as possible in view of the current pandemic situation. Mamta was seeking quashing of a 2016 FIR by the Thane police in an alleged Rs. 2,000 crore drug case, stating that there was no evidence against her.
