COURT DENIES ACTOR BAIL IN MARRIAGE PROMISE, RAPE CASE | 17 August, 2023

A sessions court in Bombay rejected the bail plea of a 38-year-old actor who was accused of raping a woman under the false pretext of marriage. The court observed that although the woman became pregnant twice due to sexual relations which took place prima facie with consent, they took place only because of the promise of marriage. The accused claimed that he was willing to marry the woman but she refused.

“After going through the material on record, it is seen that for about two occasions, the informant became pregnant from the applicant…,” the judge said, adding, “It is further seen that the applicant refused to marry only when he came to know that the informant is pregnant for the second time. Thus there is reason to believe that the applicant has committed the alleged offence.” The judge also observed that there was a dacoity case pending against the accused at the Oshiwara (Bombay) police station.

The accused was arrested on June 23. The prosecution and the woman opposed the actor’s bail plea.

The former couple met in 2021 and got into a relationship. The woman alleged that while the first pregnancy ended in a miscarriage, the accused refused to marry her after the second pregnancy. He also refused to return Rs. 98 lakh which he had taken from her for his business. The woman alleged that the accused had not one but four criminal cases pending against him. She also said, she had refused to marry him.

In his bail application, the accused said that there was a delay in lodging the FIR. He also submitted that he was ready to marry the woman even today, but she did not want to marry him. He further said, it was difficult to accept that he had received Rs. 98 lakh from her in cash.
