SC TO NCB: CAN’T CHALLENGE HC’S OBSERVATIONS IN RHEA’S BAIL CASE | 19 March, 2021

The Supreme Court yesterday (March 18) told the Narcotics Control Bureau (NCB) that it would have to challenge the Bombay high court order granting bail to Rhea Chakraborty in the drugs case related to the suicide of Sushant Singh Rajput if it wanted to assail adverse remarks made in the judgement. A bench headed by Chief Justice S.A. Bobde took note of the submission of solicitor general Tushar Mehta, on behalf of the NCB, that the probe agency was not pressing against the grant of bail to Rhea.

Mehta told the apex court that the HC made certain “wide-ranging observations” about the Narcotic Drugs and Psychotropic Substances Act, which would make it very difficult for the NCB to prosecute Rhea and ensure her conviction. The SC remarked, “You cannot challenge the bail order observations without challenging the bail order itself.”
